What is Divorce Mediation & Why is it Better?
Mediation is a “client-driven” process that focuses on the needs, rights, and interests of the spouses. Our mediator uses a wide variety of techniques to guide the process in a constructive direction, to help the parties find their optimal solution. A mediator is facilitative in managing the interaction between parties and facilitates open communication.
Collaborative Divorce
Sharing outside Experts where necessary. (The parties agree to implement outside experts where necessary in a cooperative fashion and share the costs related to those experts. (e.g. real estate appraisers, business appraisers, retirement and pension actuaries, accountants, counselors, etc.))
Legal Separation
Allows a couple to live separately but remain married. During a period of legal separation, neither spouse may remarry or enter a domestic partnership. The procedure for legal separation in California is very similar to that of divorce.
Parenting Plans
A parenting plan, also called a “custody and visitation agreement,” is the parents’ written agreement about a time-share schedule for when the children will be with each parent; and Decisionmaking on How the parents will make decisions about the health, education, and welfare of the children.
Asset and Debt Division
When you divide your property and debt, our mediators will guide you to come up with an agreement that divides everything fairly, so that you each end up with roughly the same value of your property and debt. Dividing your property does not necessarily mean a physical division.
Same Sex/Domestic Partnership Divorce and Legal Separation
Unlike traditional divorces, same sex divorces may also require the parties to dissolve a domestic partnership. Domestic partnerships are viewed similarly to marriages in the state. You may need to dissolve both a marriage and a domestic partnership if you are legally bound by both covenants.
